Dry Creek Rental Properties' policy on Emotional Support Animals and Service Animals:

While we offer some pet friendly rentals, several of our units have a strict “no pets” policy. We DO allow legitimate Emotional Support Animals and Service Animals. However, due to the increase in "fake" service animal certifications and recent laws that allow for fines for these faked service animals, we have extensively researched the Fair Housing Act and know that we are allowed to ask for the following information:

  • (1) Does the prospective tenant have a disability, i.e., a physical or mental impairment that substantially limits one or more major life activities?
  • (2) Does the prospective tenant have a disability-related need for an assistance animal? In other words, does the animal work, provide assistance, perform tasks or services for the prospective tenant, or provide emotional support that alleviates one or more of the prospective tenant's symptoms or effects of their EXISTING disability?


If the answers to BOTH questions 1 and 2 are "yes", we would require the prospective tenant to submit a request for reasonable accommodation to possess an assistance animal,
in writing. This request should include a note from their mental health professional (for an ESA), or their physician who manages their physical disability (for a Service Animal) and should accompany the rental application. The physician’s note does NOT need to say what the disability is.

If the answer  is “no” then the FHAct and Section 504 DO NOT require a modification to our “no pets” policy and we advise these prospective tenants to be sure that they are aware of the laws before attempting to pass off pets as legitimate service animals.
